The act dates back to 1996 and it regards patients’ records. Medical facilities throughout the country have been notified that this act will be enforced. A new appointed standards group JCHO (Joint Commission of Healthcare Organizations) have begun processing standards to enforce this act. So, get your shredder now! The act "establishes standards for many healthcare entities including, but not limited to health plans, healthcare clearinghouses, and healthcare providers including hospitals and general practitioners". These providers are required to "protect the privacy of certain individually identifiable health information". To translate this in simple English this act is stating that any patient records that contain medical information, medical history, social security numbers, ID numbers, credit card, health insurance or any others personal information must be made unreadable when discarded. In addition these organizations are no longer permitted to sell names or customer list for marketing use.
The EPA is very much against the burning or incinerating of waste or records, but due to conflicts of interest or pushing any particular market, they cannot demand that records be shredded. They are however, pushing for methods that promote recycling and clean environment standards.
